Both examples (1) and (2) were taken from the introduction of contracts. In some cases, it was necessary to correct entire sentences (4), which significantly increased the time required to correct the translation. It was also very strange to discover, because such sentences are very formulas and appear in every contract. Among the analyzed translations of specialized texts, most sentences are translated in an understandable way. However, some of them contained factual or grammatical errors that made it difficult to understand the content (1), (3). The aim of the study is to analyse certain Polish and English clauses of copyright transfer agreements with a view to revealing the quality of Google Translate`s translation. The following search method was used: In example (3), the first sentence is only partially translated. The program leaves out the essential content contained in the original. The terminology used should also be corrected, e.g. « wyczerpywać » translated as « escape » instead of « cover », « roszczenia pieniężne » as « monetary claims » instead of « monetary claims ». We must take into account the meaning of the Polish word « wyczerpywać ». Polish Dictionary (SJP) offers four different meanings.
The first refers to the drawing of something, for example. B by removing a liquid or bulk material with something until the container is empty. The second is the use or exploitation of something. The third sense causes the loss of physical and mental strength. The last meaning concerns something that has been said and to which nothing more can be added, since the subject has been dealt with in its entirety. The word roszczenie (lit. claim) in civil law is the right to require a particular person to behave in a certain way. While pieniężny literally means: monetary, financial, money, without money, monetary; in legal language + claim = pecuniary claim.
English-language contracts contain a name in the title: Agreement (Pl. umowa) or Contract (Pl. umowa) and an adjective that specifies the subject matter of the contract in the Polish translation (in English, publishing is a gerundial form – the active participle, which also acts as a name), e.B publishing contract. From a grammatical point of view, the publication agreement is a compound noun composed of the general form of publication and a name agreement. Sometimes in the title of the contract there is a specification about the work to be published, for example a book.B publishing contract or an article publishing contract. As we have already mentioned, English publishing contracts are usually referred to as publishing agreements in the header, but there are also contracts that do not have a title and it is only from the clause on the object of the contract that we learn what it is. Some contracts in English are exemplary. This is a specific contract template that already indicates in the header what the contract can be. Next, you need to remove the terms that do not belong to the purpose of the contract. First, let`s find out what an agreement really is. The Merriam-Webster Dictionary contains the following definitions: 1.a. the act or act of consent; 1.b.
Harmony of opinion, action or character: harmony; 2.a. an agreement on the procedure; 2.b. Compact, contract; 3.a. a properly executed and legally binding contract; 3.b. the language or instrument in which such a contract is incorporated. As we can see, the three terms reflect the idea of the agreement as it is used in legal texts. They are so closely related that one by one is defined and can be used interchangeably depending on the context. In summary, it can be said that in texts comparable to publishing contracts, the term Umowa wydawnicza functionally corresponds to the term publishing contract.
